[42 N.Y.2d 928 Page 928] Appeal from an order of the Appellate Division of the Supreme Court in the First Judicial Department, entered July 8, 1976, which (1) reversed, on the law, and vacated a judgment of the Supreme Court in favor of plaintiff, entered in New York County upon a verdict rendered at a Trial Term (Irving H. Saypol, J.), and (2) dismissed the complaint. Plaintiff Process Plants Corp. (Process) commenced this action as beneficiary to recover the proceeds of a life insurance policy issued on the life of Guy Barbolini. Barbolini was an employee and president of Process, and he died on October 2, 1968, of a heart attack, the policy having been issued on December 8, 1967. Defendant insurer refused payment under the policy on the ground that the decedent made misrepresentations as to his physical condition. The Appellate Division stated, inter alia, that decedent had had numerous cardiac related complaints [42 N.Y.2d 928 Page 929]
